Scooter Rental Agreement

Applies to all scooter rentals (Vitalia Vespa-style 150cc, Mike, Dennis, Al/Romeo, 125cc Scooter Fleet). When you check the consent box at checkout, you agree to all three sections below.

01 Liability, Damage & Theft

What you're responsible for

While the scooter is in your care — from key handover to return — you're responsible for any damage, loss, or theft that occurs.

Liability cap: $1,900 USD

This is the maximum we'll charge against the card on file even in a total-loss scenario. Minor damage (scuffs, broken mirrors, lost keys) is charged at actual repair cost — never more than the cap.

Theft insurance (optional add-on)

Theft insurance is available at checkout for 100 MXN/day. If purchased, it covers theft only — not crash damage, drops, or misuse. If not purchased and the scooter is stolen, you remain liable up to the full $1,900 cap.

What's included free

  • Material damage coverage (third-party damage to other vehicles)
  • Medical expenses coverage
  • Limited liability up to 400,000 MXN for third-party legal claims
  • Roadside assistance
  • Helmets (mandatory by law)
  • Gas (full tank at pickup, return full)
  • GPS tracking

How we charge for damage

Your card is securely saved on file at booking. If damage occurs, we send photos + an itemized invoice before charging. You have 24 hours to flag any disagreement; after that, the charge runs against the saved card automatically.

Not covered

  • Damage from operating while intoxicated or in violation of Mexican traffic law
  • Off-road damage (scooters are paved-road only)
  • Damage from carrying more than 1 passenger
  • Loss of helmet, mirrors, or accessories beyond reasonable wear
02 Cancellation & Refund Policy

More than 24 hours before pickup

Cancel for a 50% refund. Refunds are processed back to the original payment method within 5–7 business days.

Within 24 hours of pickup

Cancellations within 24 hours of pickup are charged 100% of the reservation.
  • For cash payments (not yet paid online): the full amount is charged to the card on file.
  • For credit card payments (already paid): no refund is issued.

No-shows

If you don't arrive at pickup and don't cancel beforehand, the reservation is treated as a same-day cancellation under the rules above.

Weather, illness, or travel disruption

Documented circumstances outside your control — flight cancellation, hospital admission, hurricane warning issued by the Mexican government — message us as soon as possible and we'll work something out (rebooking credit, partial refund, or full refund at our discretion).

If we cancel

If we cancel for any reason on our side (vehicle breakdown, road closure, force majeure), you receive a 100% refund and our genuine apology, plus help finding an alternative.

03 Driver Requirements & Use Terms

Driver requirements

  • Prior scooter driving experience required. We do not rent to first-time riders. If you arrive at pickup without experience, your reservation is forfeit.
  • You must be at least 18 years of age with a valid driver's license from your home country.
  • You must be physically able to operate the scooter safely.

Helmets & safety

Helmets are mandatory and provided free. Riding without a helmet is illegal in México and grounds for immediate termination of the rental at your expense.

Where you can ride

Paved roads only — Tulum town, the beach road, and the Tulum–Coba highway. No off-roading, jungle paths, or unpaved tracks. Rentals valid within Quintana Roo state; no trips to neighboring states without explicit written permission.

Passengers

Scooters are rated for one rider plus one passenger only. Carrying more passengers voids insurance and breaches this agreement.

Fuel & return

Full tank at pickup. Return full or pay refueling fee at pump rate plus service charge. Late returns billed by the hour at the standard hourly overage rate.

Prohibited use

  • Operating under the influence of alcohol or drugs
  • Racing, stunting, or commercial photo/video shoots without prior permission
  • Subletting or transferring to anyone not named on the reservation
  • Carrying livestock or hazardous materials

Local law

Follow all Mexican traffic laws. Tickets or fines issued during the rental period are your responsibility. Tickets forwarded to us as the registered owner must be reimbursed within 30 days.
